PORTLAND, Ore. (KOIN) Three men, including former Adidas executives James Gatto and Merl Code, lost their motion to have federal criminal charges dismissed in a college basketball corruption investigation.

CBS Sports reports a US District Court judge denied the motion from Gatto,

Code and ex sports agent Christian Dawkins. They argued their alleged actions of funneling money from Adidas to the families of basketball recruits to get players to sign with Adidas sponsored schools, does not constitute a federal crime.

Each of those 3 men face one felony count of wire fraud, CBS Sports reports. Their trial is scheduled to begin October 1.

In a January 8 filing by Gatto lawyers, they requested all documents the government may have “concerning payments by Nike or Under Armour or any representatives, employees, or consultants thereof, to induce high school basketball players to attend NCAA affiliated universities.”

So far the university has said it has no subpoenas that meet the journalists requests. KOIN 6 News through public records requests has learned UO has a law firm that specializes in NCAA infractions on retainer. Since 2016 the team of lawyers is led by Mike Glazier, who has been dubbed “The Cleaner” for his work in helping universities facing NCAA investigations.
